We were contacted by our client Mrs B regarding her husband Mr B, who had been in nursing care for two years.
Mrs B had been paying for Mr B’s care fees on a private basis, having been told by her local council that Mr B was not eligible for council funding as his assets exceeded the relevant capital thresholds.
Mrs B had heard about the possibility of obtaining funding from the NHS for her husband’s care fees. She found our details through Solicitors for the Elderly (a national organisation of solicitors who specialise in legal issues affecting older and vulnerable people) and contacted Kerry Blackhurst for advice.
We were able to assist Mrs B in pursuing a claim for NHS Continuing Healthcare Funding. Kerry provided advice and advocacy to Mrs B throughout the lengthy local and independent appeals process. We were successful in establishing that Mr B had met the relevant eligibility criteria for funding since entering care. As a result of our efforts the NHS agreed that Mr B should receive a lump sum by way of restitution to represent the care fees which should have been funded by the NHS. Together with interest this amounted to nearly £100,000.
We were also able to advise Mrs B on her responsibilities as Financial Attorney for Mr B, and in particular the importance of keeping Mr B’s finances separately from her own.
