A personal injury claim is a claim for compensation resulting from an accident. The critical element is that the accident results from someone else’s actions or a lack of due care (particularly in the workplace). A personal injury claim is a process of claiming monetary recompense to cover the trauma of your injury (both mental and physical). During the consultation period, your injury claims expert will look at all the evidence. They’ll examine medical reports, witness statements and police reports (if relevant). They may arrange for further assessments to determine the nature and extent of your injuries. They’ll also assess the longer-lasting effects, including whether you need additional treatment or long-term care.
Once all the information is collated, your solicitor will submit the claim for compensation to the other party (the defendant). This sets the formal process in motion.
At this point, the defendant may accept liability for the accident. There will then be a series of negotiations between your solicitor and the defendant’s legal team to arrange compensation. If they deny responsibility, the case will progress to a court hearing. This is rare but can happen, especially in more complex medical negligence cases.
Once the claim is settled, you’ll receive your compensation. Your legal fees will be taken from the final amount. If you lose your case and have taken a ‘no win, no fee’ option, you’ll pay nothing.
It depends on the case. Complex cases can take months or even years to resolve, especially if the defendant denies responsibility for the accident. However, more straightforward cases should progress quickly. The most important thing is to seek legal advice as soon as possible. A victim of personal injury can claim for General and Special Damages.
