Working families with babies in neonatal care will soon be entitled a day one right to Neonatal Care Leave. There is no such legal right in place at present, meaning many working families have to return to work whilst their babies are in neonatal care in hospital, or use other leave such as annual leave or sick leave.
The introduction of Neonatal Care Leave will apply to parents of babies who are admitted into neonatal care up to 28 days old, with a continuous stay in hospital of 7 days or more. Eligible parents will be able to take up to 12 weeks of leave in addition to any other applicable leave, such as maternity or paternity leave.
As well as the entitlement to leave, Statutory Neonatal Care Pay will be available to those who meet the minimum service and earnings thresholds.
The new regulations will take effect from 6th April 2025. Employers are advised to seek legal advice to ensure the correct leave and pay provisions are in place for eligible parents in these situations. It is also advisable to review employment policies and procedures to ensure they are reflective of the new statutory entitlements.
